 "text": "\n# Forskrift om særskilte beskyttelsestiltak rettet mot import av muslinger fra Tyrkia\n\n## § 1. Virkeområde\n\nForskriften omfatter en stikkprøvekontroll av frosne eller bearbeidede muslinger for E.coli og biotoksiner, og et importforbud rettet mot levende eller kjølte muslinger, med opprinnelse i eller sendes fra Tyrkia, når Norge er første mottaksstat innen EØS-området.\n\nForskriften omfatter produkter som er beregnet på konsum, og som faller inn under tollposisjonene 03.07 og 16.05 i tolltariffen.\n\nVed konflikt mellom forordningens bestemmelser og denne forskriften, går alltid forordningens bestemmelser foran.\n\n## § 2. Særlige importbetingelser for muslinger fra Tyrkia\n\n[EØS-avtalens vedlegg I kapittel I](avtale/avt-1992-05-02-1-v1/kapI) del 7.1 nr. 13 og vedlegg II kap. XII nr. 54zzzc (forordning [(EU) 2022/478](eu/32022r0478), som endret ved forordning [(EU) 2024/360](eu/32024r0360)) om videreføring av særskilte beskyttelsestiltak mot import av muslinger fra Tyrkia gjelder som forskrift med de tilpasninger som følger av vedlegg I og II, protokoll 1 til avtalen og avtalen for øvrig.\n\n> Endret ved forskrift [29 jan 2024 nr. 136](forskrift/2024-01-29-136).\n\n## § 3. Tilsyn og vedtak\n\nMattilsynet fører tilsyn og kan fatte nødvendige enkeltvedtak, jf. [matloven § 23](lov/2003-12-19-124/§23), for å oppnå etterlevelse av bestemmelser gitt i eller i medhold av denne forskriften. Mattilsynet kan også fatte enkeltvedtak i henhold til [matloven § 24](lov/2003-12-19-124/§24) til [§ 26](lov/2003-12-19-124/§26).\n\n## § 4. Straff\n\nOvertredelse av bestemmelser gitt i denne forskriften eller enkeltvedtak gitt i medhold av forskriften, er straffbart i henhold til [matloven § 28](lov/2003-12-19-124/§28).\n\n## § 5. Dispensasjon\n\nMattilsynet kan i særskilte tilfelle dispensere fra bestemmelsene i denne forskriften, forutsatt at det ikke vil stride mot Norges internasjonale forpliktelser, herunder [EØS-avtalen](lov/1992-11-27-109/eøsl).\n\n## § 6. Ikrafttredelse\n\nDenne forskriften trer i kraft 29. mars 2022.\n\nSamtidig oppheves [forskrift 2. august 2013 nr. 943 om særskilte beskyttelsestiltak ved import av muslinger fra Tyrkia](forskrift/2013-08-02-943).\n\n## Forordninger\n\n### Forordning [(EU) 2022/478](eu/32022r0478) om videreføring av særskilte beskyttelsestiltak mot import av muslinger fra Tyrkia (Engelsk)\n\n> Endret ved forskrift [29 jan 2024 nr. 136](forskrift/2024-01-29-136).\n\nNedenfor gjengis til informasjon en engelsk utgave av [EØS-avtalen vedlegg I kap. I](avtale/avt-1992-05-02-1-v1/kapI) del 7.1 nr. 13 og vedlegg II kap. XII nr. 54zzzc (forordning [(EU) 2022/478](eu/32022r0478) og forordning [(EU) 2024/360](eu/32024r0360)), med de endringer og tillegg som følger av EØS-tilpasningen av rettsakten i samsvar med vedlegg I og II, protokoll 1 til avtalen og avtalen for øvrig.\n\nForordning [(EU) 2022/478](eu/32022r0478) er konsolidert til og med endringer gjennomført ved forordning [(EU) 2024/360](eu/32024r0360).\n\n►**B** Kommisjonens gjennomføringsforordning [(EU) 2022/478](eu/32022r0478) av 24. mars 2022\n\nsom endret ved:\n\n- ►**M1** Kommisjonsforordning [(EU) 2024/360](eu/32024r0360) av 24. januar 2024\n\n### COMMISSION IMPLEMENTING REGULATION (EU) 2022/478\n\nof 24 March 2022\non maintaining protective measures on imports of bivalve molluscs from Turkey intended for human consumption\n\n(Text with EEA relevance)\n\nTHE EUROPEAN COMMISSION,\n\nHaving regard to the Treaty on the Functioning of the European Union,\n\nHaving regard to [Regulation (EU) 2017/625](eu/32017r0625) of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products, amending Regulations [(EC) No 999/2001](eu/32001r0999), [(EC) No 396/2005](eu/32005r0396), [(EC) No 1069/2009](eu/32009r1069), [(EC) No 1107/2009](eu/32009r1107), [(EU) No 1151/2012](eu/32012r1151), [(EU) No 652/2014](eu/32014r0652), [(EU) 2016/429](eu/32016r0429) and [(EU) 2016/2031](eu/32016r2031) of the European Parliament and of the Council, Council Regulations [(EC) No 1/2005](eu/32005r0001) and [(EC) No 1099/2009](eu/32009r1099) and Council Directives [98/58/EC](eu/31998l0058), [1999/74/EC](eu/31999l0074), [2007/43/EC](eu/32007l0043), [2008/119/EC](eu/32008l0119) and [2008/120/EC](eu/32008l0120), and repealing Regulations [(EC) No 854/2004](eu/32004r0854) and [(EC) No 882/2004](eu/32004r0882) of the European Parliament and of the Council, Council Directives [89/608/EEC](eu/31989l0608), [89/662/EEC](eu/31989l0662), [90/425/EEC](eu/31990l0425), [91/496/EEC](eu/31991l0496), [96/23/EC](eu/31996l0023), [96/93/EC](eu/31996l0093) and [97/78/EC](eu/31997l0078) and Council Decision [92/438/EEC](eu/31992d0438) (Official Controls Regulation)(1), and in particular Article 128[^1] thereof,\n\nWhereas:\n\n1. Commission [Implementing Regulation (EU) No 743/2013](eu/32013r0743)[^2] was adopted as Commission audits identified deficiencies in the implementation of official controls by the Turkish competent authorities on the production of bivalve molluscs intended for entry into the Union, and as Member States reported non-compliant consignments of bivalve molluscs originating in Turkey which were not fulfilling Union microbiological standards.\n2. The most recent Commission audit which took place in September 2015, found that significant deficiencies in the control system for bivalve molluscs intended for entry into the Union, remained.\n3. In January 2020, the Turkish competent authorities have presented information regarding the corrective measures initiated to address those deficiencies. Whilst that initially has been assessed favourably on paper, an audit on the spot to verify the implementation of those actions has not been possible yet due to COVID-19 pandemic restrictions. Until the outcomes of this audit have been considered favourably, the measures imposed by [Implementing Regulation (EU) No 743/2013](eu/32013r0743) should remain in place.\n4. [Implementing Regulation (EU) No 743/2013](eu/32013r0743) expired on 31 December 2021. In addition, given that [Council Directive 97/78/EC](eu/31997l0078)[^3], constituting the basis for the above Regulation, is no longer applicable, the legal basis of the Commission Implementing Regulation should be updated to refer to [Article 128 of Regulation (EU) 2017/625](eu/32017r0625/a128).\n5. The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Plants, Animals, Food and Feed,\n\n1 OJ L 95, 7.4.2017, p. 1.\n\n2 Commission [Implementing Regulation (EU) No 743/2013](eu/32013r0743) of 31 July 2013 on introducing protective measures on imports of bivalve molluscs from Turkey intended for human consumption (OJ L 205, 1.8.2013, p. 1).\n\n3 [Council Directive 97/78/EC](eu/31997l0078) of 18 December 1997 laying down the principles governing the organisation of veterinary checks on products entering the Community from third countries (OJ L 24, 30.1.1998, p. 9).\n\nHAS ADOPTED THIS REGULATION:\n\n### Article 1. Subject matter\n\nThis Regulation shall apply to live, chilled, frozen and processed bivalve molluscs intended for human consumption (CN Codes: 0307, 1605) and originating in or dispatched from Turkey.\n\n### Article 2. Prohibition of entry of live and chilled bivalve molluscs\n\nMember States shall not allow entry into the Union of live and chilled bivalve molluscs originating in or dispatched from Turkey.\n\n### Article 3. Measures concerning frozen and processed bivalve molluscs\n\n1\\. Member States shall, using appropriate sampling plans and detection methods, carry out tests on consignments of frozen and processed bivalve molluscs originating in or dispatched from Turkey as provided for in paragraph 2.\n\nThose tests shall take place at the border control post of entry into the Union of the consignments concerned.\n\n2\\. Member States shall carry out the tests necessary to identify:\n\n1. the contamination level of Escherichia coli in all consignments of frozen bivalve molluscs;\n2. the presence of marine biotoxins in all consignments of frozen or processed bivalve molluscs.\n\n3\\. The consignments subjected to tests referred to in paragraphs 1 and 2 shall stay under supervision of the competent authorities at the border control post concerned until the results of those tests are received and assessed.\n\n4\\. If the tests referred to in paragraphs 1 and 2 indicate that a consignment is likely to be injurious to human health, the competent authority shall immediately seize and either destroy the consignment or subject it to special treatment as provided for by Article 67 of Regulation [(EU) 2017/625](eu/32017r0625) and in accordance with Article 71(1) and (2) of that same Regulation.\n\n### Article 4. Expenditures\n\nAll expenditures incurred by the Member States in the application of this Regulation shall be charged to the operator or his/her representative responsible for the consignment at the time of presentation of that consignment to the border control post of entry into the Union.\n\n### Article 5.
